On August 24, 2018, Governor Bruce Rauner signed SB2516 (now Public Act 100-1071) amending the Abused and Neglected Child Reporting Act (“Act”). Under the Act, “mandated reporters” (e.g., physicians, school personnel, medical examiners, home health aides and law enforcement officers) who have “reasonable cause to believe a child known to them in their professional or official capacity may be an abused child or a neglected child shall immediately report or cause a report to be made” to the Department of Children and Family Services (“DCFS”). By signing SB2516, Governor Rauner enhanced the form that mandated reporters must sign when they begin employment, which is already provided by DCFS. Currently, when a mandated reporter begins employment, they are required to execute a form that affirms they have “knowledge and understanding” of the reporting requirements under the Act. On or after January 1, 2019, DCFS will amend the form to include information regarding available mandated reporter training provided by DCFS.
